Summary

What the record shows

Theranos promoted technology that it said could perform many blood tests from a very small sample. The Securities and Exchange Commission charged that the company and its leaders raised more than $700 million while making false or exaggerated statements about the technology, business and financial performance.

A jury convicted Elizabeth Holmes of one investor-fraud conspiracy count and three wire-fraud counts. She was sentenced to 135 months in prison. Ramesh “Sunny” Balwani was convicted separately and sentenced to 155 months. Their convictions were upheld on appeal in 2025.

Holmes contested the criminal allegations, pleaded not guilty and argued on appeal that evidentiary and trial errors required a new trial.

The Ninth Circuit rejected the appeal and affirmed the convictions. Subsequent reporting has noted that Holmes continues to maintain her innocence.
